On Tuesday, 49ers safety Donte Whitner found out that he will have to wait until the NFL offseason to legally change his last name to Hitner.

Whitner had planned earlier in the season to remove the W from his last name in protest to the penalties he has draw for hits. However, the process was delayed by the shutdown of the Federal government. Despite the judges' decision,  the controversial safety, who was fined $21,000 earlier this season for a hit against the St. Louis Rams, seems determined to add to his own notoriety.
